New rule on pro hac vice counsel in Virginia

Wednesday, November 29th, 2006
Virginia Lawyers Weekly is reporting that the Virginia Supreme Court has adopted a new rule restricting the appearance of out-of-state counsel pro hac vice in Virginia cases.

I hate these kinds of rules when I go to West Virginia or Kentucky. Here on the Virginia-Tennessee border, I have not heard that there is a problem of Tennessee-only licensed lawyers running amok on the Virginia side.

So long as there is local counsel licensed Virginia at every hearing and every deposition and on every paper, and so long as pro hac vice lawyers are subject to Virginia discipline, the rest seems like a waste to me, including the fees and paperwork.

North Carolina Winter

Wednesday, November 29th, 2006

NcwinterI do not regularly use the same pictures on my internet posts.  I try to pick something unique for each site. This morning I ended up using the same shot on Coastalnc.org as I have used in this post.  The picture has such warm tones that it matches the weather, and I could not resist.

I was filling up with gas yesterday, and someone across the pump island asked me if I like this North Carolina winter?  It was pretty hard to respond with anything by a strong yes since I switched back to shorts as my standard clothing yesterday.

I know much of the country has enjoyed some warmer than normal temperatures.  When we have so many other problems to worry about, it is nice to take the weather off the list for a while.  I did notice that my friends in Halifax, Nova Scotia are seeing temperature just around thirty degrees Fahrenheit.   All I can say is that there are plenty of warmer places to flee to this time of year, and the Canadian dollar is strong, so they have no excuse.

It is so bright today that even with a filter on my digital camera, it is hard to get any blue sky.  That kind of problem is the right kind to have.

Back & Hamstrings: Our Picks From The 50s Series

Wednesday, November 29th, 2006
Like the warm-up, BodyPump back & hamstrings tracks have a distinct sound that became even more pronounced over the 50's series. Play track #4 for any two or three 50's releases and you'll see what we're talking about. The workout routine sequences are noticeably similar as well - so much, in fact, that many instructors learn this track the first time through.

With so much similarity, picking the best, worst, and most memorable wasn't an easy task. Here's what we came up with:
Best: Here I Am (Jan Wayne feat. Charlene) - BodyPump 54 - A strong background beat punctuates this energy laden track from start to finish. Runners up: The 50-52nd releases - Slave to the Music, Fly on the Wings of Love, and Land of the Living for turning up the heat by dropping the dead row from the clean & press sequence for the first two sets - now that is a workout!

Worst: Olympia (E-Type) - BodyPump 55 - While this track surely made an excellent pick as the official song for the Swedish Olympic team in Athens, the long drawn-out intro makes it stick out like a sore thumb in a BodyPump workout. Heart rates plummet by the time the first set of clean and presses roll around, and the break before the final set is our only rouse from a routine that puts us right to sleep.

Most Memorable: Land of the Living (Milk Inc.) - BodyPump 52 - Well, only for us. You know the weird little synth number right after each set of seven dead rows? That's where Tami makes me do a shimmy in front of class. I feel so cheap.
Well we finally pulled it together - our picks for the best, worst, and most memorable back & hamstrings tracks from the 50s series. It wasn't easy, but the next one's a cinch: Triceps

How I feel!

Wednesday, November 29th, 2006
Well I may touch a nerve and I hope I do but here it goes.....

As I was leaving station 1 this morning after a busy but good shift, I noticed all of the canidates coming to take the test. Everyone look nervous but they were all excited. Most were Volunteers somewhere and a few were coming from other (Larger) career departments. Well my point is they want to have the same job I have. As I was driving home I found myself wanting to be downtown today to see them all take the test, but I could not stay. I am excited that we are getting ready to hire and promote. All I hope is that whoever gets promoted and hired is that they love the job and they do the very best they can (and I don't see any problem with that). NOW my point, I have been lucky enough to work on every shift and this week I worked overtime on "B" shift and they have some hardworking and great guys.....but just as on ALL shifts we have some people that try to find the easy way out....in other word some people are a little lazy correction some people are VERY LAZY! Now this is my opinon and mine alone! First of all, I no we all can be lazy but somethings I witnessed over the past couple of weeks are uncalled for. I will not say names but you know who you are. All I have to say is I worked with guy yesterday and yes, he is a friend but more so he is a BROTHER. This person had been up all night sick he was very week BUT he still worked his BUTT OFF yesterday and I did not hear him complain NOT ONCE. You could tell that he did not feel well but there he was still working and working hard. This person is stronger on a bad day then most of us on a great day! We have a great department and great people......so all I want to say is the few people (and you know who you are) Shape up or get out so we can replace you with someone who will love the job and work hard! This means take a class, Teach a drill something get involved but just DO SOMETHING!

Good luck to the LT's taking the Captains test ....... and to the folks taking the test to get hired.

Comment on this please but NO NAMES other than yours if you want to.
